1) About Willow & Breathe

Willow & Breathe (“we,” “our,” or “us”) is operated by an individual educator and creator. The website provides mindfulness and educational resources designed for use in classrooms and at home.

Our offerings include:

• Mindfulness audio and video recordings
• Social-emotional learning (SEL) lessons
• Bedtime stories and calming narratives
• Educational videos and resources for teachers and families
• Subscription access (monthly, yearly, or free trial options)

These materials (the “Content”) and all access through our website (the “Site”) are collectively called the “Services.”

By using our Site or Services, you agree to these Terms & Conditions (the “Terms”). If you do not agree, please do not use the Site.

2) Educational Purpose Only

Willow & Breathe is intended for educational and mindfulness purposes only. We do not provide therapy, counselling, medical advice, diagnosis, or treatment.

Always seek guidance from a qualified healthcare professional for any mental- or physical-health concerns.

In an emergency:

• In Canada, call or text 988 (Suicide and Crisis Helpline).
• For immediate danger or medical emergencies, call 911 or your local emergency number.

3) Intended Users

• The Services are created for teachers, parents, and guardians to use with children in classrooms or at home.
• You must be 18 years or older to create an account or purchase a subscription.
• Children may engage with our Content only under adult supervision.
• We do not knowingly collect personal information from children.

You are responsible for maintaining the confidentiality of your account and password and for all activity under your account.

4) Accounts, Subscriptions, and Cancellations

4.1 Creating an Account
You may need to create an account to access certain features. All information must be accurate and kept up to date.

4.2 Subscriptions and Trials
We may offer paid monthly or annual subscriptions, and sometimes free trials. Free trials automatically convert to paid plans unless cancelled before the trial ends.

4.3 Renewal and Billing
Subscriptions automatically renew until cancelled. You authorize us (or our payment processor) to charge your chosen payment method for each renewal period and applicable taxes.

4.4 Cancellations
You may cancel your subscription at any time by following the cancellation instructions on the Site or by emailing willowandbreathe@gmail.com.
Cancellations take effect at the end of your current billing cycle.

4.5 Refunds
Except where required by law, payments are non-refundable. Consumer-protection laws in your area (including in Canada) continue to apply where they cannot be limited by contract.

4.6 Price Changes
We may adjust subscription pricing or plans and will provide reasonable notice where required by law.

5) Acceptable Use

You agree to use Willow & Breathe respectfully and lawfully. You must not:

• Copy, record, download, or distribute our Content beyond your personal or classroom use.
• Share account credentials or upload our materials to public drives, social media, or resale sites.
• Use the Site for illegal, harassing, or discriminatory behaviour.
• Interfere with or attempt to gain unauthorized access to the Site.
• Use automated systems to scrape or collect data or content.
• Claim our materials as your own or use them commercially without written permission.

We may suspend or terminate your access for misuse or violations of these Terms.

6) Classroom and Home License

While your subscription is active, Willow & Breathe grants you a limited, non-exclusive, non-transferable, revocable license to use our Content for:

• Personal use at home with children in your care; and
• Educational use in your own classroom as a teacher, educator, or support staff.

This license does not allow you to:

• Share or distribute files outside your household or class;
• Upload materials to public or shared online spaces;
• Include our Content in your own paid courses, workshops, or products without written permission.

7) Intellectual Property

All text, audio, video, artwork, designs, lesson plans, and website code are owned by Willow & Breathe or its licensors and are protected by copyright and trademark laws.

You may not reproduce, republish, or sell any materials without written consent.
All brand names, graphics, and logos remain the property of Willow & Breathe.

8) Feedback and Submissions

If you send us ideas, suggestions, or feedback, you agree we may use them freely to improve our Services without obligation or compensation to you.

9) Availability and Updates

We aim to keep the Site reliable, but access may occasionally be interrupted due to maintenance, updates, or internet issues.
We may add, remove, or modify features or content at any time.

We collect only minimal information needed for account and payment purposes and do not knowingly collect data from children.

If you or a child experiences discomfort, anxiety, or distress, stop the activity and consult a qualified health professional.

12) Disclaimer of Warranties

Our Services and Content are provided “as is” and “as available.”
We make no guarantees about uninterrupted access or specific outcomes.
To the fullest extent allowed by law, we disclaim all implied warranties, including fitness for a particular purpose and non-infringement.

Local consumer-protection rights that cannot be waived by law remain in effect.

13) Limitation of Liability

To the fullest extent allowed by law, Willow & Breathe is not liable for any indirect, incidental, special, or consequential damages (including loss of data or profits) arising from your use of the Site or Services.

Our total liability for any claim in a 12-month period will not exceed the greater of the amount you paid in that period or CAD $500.

14) Indemnity

You agree to defend, indemnify, and hold harmless Willow & Breathe from any claim, damage, or expense (including reasonable legal fees) arising from your misuse of the Services or violation of these Terms.

15) Governing Law and Disputes

These Terms are governed by the laws of Alberta and Canada, without regard to conflict-of-law principles.
Any dispute will be handled in the courts of Alberta, Canada.
If you live outside Canada, mandatory consumer protections in your own country may still apply where required by law.

16) Updates to These Terms

We may update these Terms from time to time. Significant changes will be posted on the Site with a new “Effective” date.
Your continued use after changes means you accept the updated Terms.
